bitrates are a tricky one if its a longer recording, because its hard to find the balance between sounding good and size of the file.
I tend to encode at 128 kbps joint stereo, switch that to true stereo if i'm at 160 kbps or higher, and of course if its a mono file you can halve the bitrate as you're only encoding one channel, so i'd tend to use 64 kbps mono unless there's some really good stuff to preserve. That said, I'm not particularly fussy about hearing mp3 artifacts, and I'm also not using a decent binaural setup so your milage is bound to vary.
Basically, I think it all comes down to the environments. Its rare that you can encode so wrongly that it spoils the actual action, because thats usually in the forefront of the recording unless maybe its neighbour stuff. So play around, forget about numbers and rely on your ears when you find out how each bitrate sounds, and you'll find where you're encoding happy place is easy enough. Mono files are the easiest for me, because 96 kbps is the equivalent of encoding at 192 kbps if the file were stereo, and I know when i hit that point its more than likely mind over matter if I'm still fussing over degrading the content.

It's a party scene, with too much bass beating on my little microphones. Even heavy EQ during editing didn't help much.
It's me and another woman, this one from Medellin Colombia having a go. It's not an eavesdropping thing, although the lady was not aware she (and I) were being recorded. I'm very careful when in the particular environment where I did these recordings, not to "accidentally" record one of my associates/friends/neighbors. Such recording practices could be quite hazardous to one's health. Believe it.

you're a wise man, its always best to stay on the right side of the law. Unfortunately though from time to time accidents can happen, so if you ever find you've accidentally ended up with a recording of that friend/associate/neighbour, be sure to drop me a PM to errr... share advice on what went wrong and help a fellow voyeur avoid similar situations. hehe!
